How does an F-1 student plan an OPT to H-1B transition?

Coordinate with the sponsoring employer, your designated school official (DSO) and immigration counsel. Prepare a timeline of your OPT authorization, immigration records, proposed employment and intended filing route before making work or travel decisions.

What is the cap-gap extension?

For an eligible F-1 student, a timely, nonfrivolous cap-subject H-1B petition requesting change of status can extend status and qualifying OPT employment authorization. Under 8 C.F.R. § 214.2(f)(5)(vii), the endpoint is April 1 of the fiscal year for which H-1B status is requested or the approved petition’s validity start date, whichever is earlier. Required conditions must be met; registration or selection alone is not a qualifying petition.

Can the extension end early?

Yes. Rejection, denial, revocation or withdrawal of the petition, or denial or withdrawal of the change-of-status request, can terminate the extension. Have counsel review the notice and available next steps promptly.

What records should I organize?

Keep your I-20s, EAD, I-94, passport, employment history, pay records, petition receipt and decision notices together. Ask the DSO and counsel which documents establish your status and work authorization in your circumstances.

Can I travel during the transition?

Review the filing route, petition stage, visa and re-entry documents with the DSO and counsel before booking international travel. Do not assume that continued status also settles travel or employment questions.
