USCIS RFE and NOID Response: Evidence, Deadlines and FAQs

What is an RFE response?
A Request for Evidence (RFE) asks for missing or additional evidence. A Notice of Intent to Deny (NOID) identifies grounds for a proposed denial. Read every issue in the notice alongside the original filing. Neither notice guarantees a favorable outcome.

How long do I have to respond?
Use the deadline and submission instructions stated in your notice. Do not assume an extension or rely on a general online day count. Check the delivery method, address or portal and keep proof of submission.

What should I do first?
Save the complete notice, envelope and online-account copy. Calendar the deadline, preserve the original application and prior submissions, and identify related status, work, travel or dependent-filing concerns. Share the complete record with counsel for review.

How do I organize the evidence?
Create a notice-to-record matrix: each issue, the eligibility requirement, what the original filing said, existing exhibits, missing records and who will obtain them. Compare names, dates, job descriptions and financial figures across documents; explain material inconsistencies.

What belongs in the response file?

How should the written response be structured?
Follow the notice issue by issue. Connect each explanation to a specific exhibit and page, distinguish the original filing record from later developments, and use a clear exhibit index. Under the response rules, requested materials should be submitted together; a partial submission can be treated as a request for a decision on the existing record.

How long will USCIS take after my response?
Do not treat a generic processing estimate as a promised decision date. Review the form, processing category, receipt and current case information. Preserve the final response and submission confirmation for follow-up.

What if USCIS has already denied the case?
A denial requires a separate review of the decision, applicable procedure and deadline. Do not reuse an RFE response deadline for a motion, appeal or new filing.
